Terms of Service

These Terms of Service ("Terms") govern your use of the Clutch mobile application and website operated by Clutch ("we", "us", or "our"). By downloading or using Clutch, you agree to these Terms.

1. The Service

Clutch is a football score-prediction and group score-tracking app for entertainment purposes. Users predict the exact scores of real football matches and earn points based on the accuracy of their predictions. Clutch does not provide gambling, betting, wagering, sweepstakes, prize pools, cash prizes, wallets, or any variable financial return. There are no odds, no bookmakers, and no payouts. For paid groups, the Group Access Pass is a fixed access fee for app functionality only and is not tied to match outcomes, leaderboard position, prizes, winnings, or any financial return. Some launch or promotional groups, such as 2026 international tournament groups, may be offered free of charge.

2. Eligibility

• You must be at least 18 years old to use Clutch.
• You must provide accurate information when creating your account.
• One account per person. Creating multiple accounts is not permitted.
• You are responsible for maintaining the security of your account credentials.

3. Free Groups, Group Access Pass, and Payments

• 2026 international tournament groups may be offered free for launch. Club season groups and other paid groups may require a fixed one-time Group Access Pass per player per group. The price is displayed in the app before purchase and may vary by country, currency, taxes, and app store settings.
• For paid groups, the Group Access Pass unlocks app access to one private group only. It is not a stake, wager, bet, or entry into any prize-bearing or financial contest.
• Free group access and paid Group Access Passes do not purchase, guarantee, or create any right to a prize, payout, winnings, reward, cash return, or other financial benefit.
• Payments for in-app purchases are processed by Apple App Store or Google Play, as applicable. Clutch does not collect or store full payment card details.
• Access fees are intended to be non-refundable once access to a group has been unlocked, except where a refund is required by applicable law or granted by the relevant app store.
• Refund requests for in-app purchases must be submitted through the app store where the purchase was made and are subject to that store's policies.
• Nothing in these Terms limits any non-waivable refund, cancellation, or consumer rights that apply under mandatory law.
• We reserve the right to change the Group Access Pass price for future groups with reasonable notice.

4. Group Rules, Predictions, and Scoring

• Groups are private and invitation-only. The group creator is responsible for managing invitations.
• Players may join a group late unless the group is full or completed. Late joiners only start scoring from the next available matchday.
• A group is completed when its linked football season or tournament ends. If Clutch cannot find an upcoming fixture for the selected teams or competition within 30 days, the group may be closed automatically, the final leaderboard is locked, and the end-of-season summary may be generated.
• Users submit score predictions for real football matches.
• Predictions must be submitted at least 1 hour before each match kicks off. Late submissions are not accepted.
• Points are awarded based on the 90-minute result only. Extra time, penalty shootouts, and abandoned matches do not count.
• Leaderboards and stats are provided for entertainment, group score-tracking, and comparison purposes only.

5. Acceptable Use

You agree not to:

• Use Clutch for any unlawful purpose.
• Attempt to manipulate scores, predictions, or leaderboard rankings.
• Share your account with others.
• Reverse engineer, copy, or redistribute any part of the app.
• Use automated tools or bots to submit predictions.
• Use Clutch for illegal gambling, betting, wagering, or unauthorized prize-based activities.
• Use Clutch to organize, promote, facilitate, advertise, or administer any betting, wagering, side-bets, cash pools, prize pools, lotteries, sweepstakes, or other financial contests, whether inside or outside the app.

6. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate account information, keep your login details secure, and notify us if you suspect unauthorized access.

7. Intellectual Property

All content, design, trademarks, and code within Clutch are the property of Clutch and may not be reproduced without permission. Match data is provided by API-Football and is subject to their licensing terms.

8. Third-Party Services and Match Data

Clutch relies on third-party services including app stores, payment processors, infrastructure providers, email providers, notification services, and football data providers. Match fixtures, scores, schedules, and results may be delayed, incomplete, inaccurate, postponed, cancelled, or changed by third parties. We do not guarantee the accuracy, completeness, or uninterrupted availability of match data or third-party services.

9. Disclaimers

Clutch is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted service, error-free operation, continuous availability, or that all scoring, leaderboard rankings, notifications, emails, or data updates will always be accurate or timely.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Clutch and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses arising from your use of or inability to use Clutch. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnity

You agree to indemnify and hold harmless Clutch and its operator from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the app, violation of these Terms, violation of applicable law, or use of Clutch to organize or facilitate betting, wagering, prize pools, cash pools, lotteries, sweepstakes, or other financial contests.

12. Refunds

Refunds for in-app purchases are handled by Apple App Store or Google Play according to their respective refund policies and terms. Clutch does not control app store refund decisions. Fees may be non-refundable except where required by applicable law or app store policy. Nothing in these Terms limits any non-waivable refund, cancellation, or consumer rights that apply under mandatory law.

13. Account Suspension or Termination

We reserve the right to suspend or terminate accounts that violate these Terms, misuse the service, attempt to manipulate scoring or leaderboard rankings, interfere with the app, or use Clutch for betting, wagering, prize pools, cash pools, or other prohibited financial contests. If your account is terminated for a violation, fees already paid are non-refundable except where required by applicable law or app store policy.

14. Changes to Terms

We may update these Terms from time to time. Continued use of Clutch after changes constitutes acceptance. We will provide reasonable notice of significant changes.

15. Governing Law

Clutch is currently operated by an individual based in the United Arab Emirates. These Terms are governed by the laws of the United Arab Emirates, except where mandatory consumer protection laws in your country provide otherwise. Any disputes shall first be addressed through good-faith negotiation. If a dispute cannot be resolved informally, it will be handled by the competent courts or authorities with jurisdiction under applicable law.
