Terms of Service

These Terms of Service ("Terms") govern your use of the Clutch mobile application and website operated by Clutch ("we", "us", or "our"). By downloading or using Clutch, you agree to these Terms.

1. The Service

Clutch is a skill-based football score prediction game. Users predict the exact scores of real football matches and earn points based on the accuracy of their predictions. Clutch is not a gambling service. There are no odds, no bookmakers, and no variable financial returns. The season fee is a fixed participation fee, not a stake or wager.

2. Eligibility

• You must be at least 18 years old to use Clutch.
• You must provide accurate information when creating your account.
• One account per person. Creating multiple accounts is not permitted.
• You are responsible for maintaining the security of your account credentials.

3. Season Fee and Payments

• The season fee is $15 per player per season, plus applicable VAT based on your location.
• Fees are non-refundable once a group's first matchday has begun.
• Payments are processed securely by Paddle. By making a payment, you agree to Paddle's terms of service.
• We reserve the right to change the season fee for future seasons with reasonable notice.

4. Group Rules

• Groups are private and invitation-only. The group creator is responsible for managing invitations.
• No new players may join a group after the first game of the first matchday has kicked off.
• Predictions must be submitted before the first kickoff of each matchday. Late submissions are not accepted.
• Points are awarded based on the 90-minute result only. Extra time, penalty shootouts, and abandoned matches do not count.

5. Acceptable Use

You agree not to:

• Use Clutch for any unlawful purpose
• Attempt to manipulate scores, predictions, or standings
• Share your account with others
• Reverse engineer, copy, or redistribute any part of the app
• Use automated tools or bots to submit predictions

6. Intellectual Property

All content, design, trademarks, and code within Clutch are the property of Clutch and may not be reproduced without permission. Match data is provided by API-Football and is subject to their licensing terms.

7. Disclaimer of Warranties

Clutch is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, and we are not responsible for delays or errors caused by third-party data providers (including API-Football) or payment processors.

8. Limitation of Liability

To the maximum extent permitted by law, Clutch shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. If your account is terminated for a violation, fees already paid are non-refundable.

10. Changes to Terms

We may update these Terms from time to time. Continued use of Clutch after changes constitutes acceptance. We will provide reasonable notice of significant changes.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Clutch operates. Any disputes shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
